My English Habit Terms of Service

These Terms of Service govern your use of the website at https://www.myenglishhabit.net and the services provided by My English Habit, including the Speaking Sessions membership.
 

My English Habit is the trading name of Derek Newton, a self-employed sole trader registered in the United Kingdom. Address: 80A Ruskin Avenue, Welling, London DA16 3QQ, United Kingdom.
Email: info@myenglishhabit.net. In these terms, "we", "us" and "our" mean My English Habit, and "you" means the person using the website or buying a membership.
 

By using the website or buying a membership, you agree to these Terms of Service. If you do not agree, please do not use the website or our services.
 

We may update these Terms of Service from time to time and will publish the new version on this page. If you are a member and a change affects your membership, we will tell you by email at least 14 days before it takes effect. If you do not agree with the change, you can cancel your membership before it takes effect.

Speaking Sessions membership

What the membership includes

The Speaking Sessions membership gives you access to live, online English speaking sessions led by Derek Newton, and to our private community on Skool, where you find the timetable and the session links. You can join as many live sessions as you want during your membership. You do not need to book.

Each session has a recommended minimum level. Sessions are for adults (18 and over) who can read English and understand some spoken English. They are not designed for complete beginners and do not follow a course book or structured curriculum.

Free week

New members get the first 7 days free. If you cancel before the 7 days end, you pay nothing. The free week is available once per person.
 

Price and payment

After the free week, the membership costs €67 every 4 weeks. Payment is taken automatically at the start of each 4-week period until you cancel. Payments are processed through our website (Wix) by the payment provider shown at checkout. We never see or store your full card details.

Founder price

If you join as a founder member, your price stays at €67 every 4 weeks for as long as your membership stays active. If you cancel and join again later, you pay the price at that time.
 

Price changes

Whatever price you join at, you keep that price for as long as your membership stays active. If we change the price of the membership in future, the new price only applies to people who join after the change. If you cancel and join again later, you pay the price at that time.

Cancelling

There is no minimum period. You can cancel at any time: log in at www.myenglishhabit.net, open your member's area and cancel your plan there. If you have any problem cancelling, email billing@myenglishhabit.net and we will cancel it for you.

When you cancel after the free week, you keep your access until the end of the 4-week period you have already paid for. We do not refund partial periods, except as set out in "Your right to cancel within 14 days" below, or where the law requires it.
 

Your right to cancel within 14 days

If you are a consumer, you have a legal right to cancel within 14 days of the day you sign up, without giving a reason. Because the sessions start straight away, by signing up you ask us to start providing the service during this 14-day period.

If you cancel within 14 days of signing up and you have already paid for a 4-week period, we will refund that payment minus a fair amount for the days of that period that have already passed. To use this right, cancel in your member's area or email billing@myenglishhabit.net within the 14 days.

Timetable changes and missed sessions

Session days and times can change, and sometimes there is a short break, for example on public holidays. We hold regular polls in the community to choose the best times, and we announce changes in advance in the community. If we ever need to cancel a session at short notice, we will tell members as soon as we can. There are no refunds for individual sessions you miss or that are moved.

If we stop offering the membership altogether, we will tell you at least 30 days in advance and stop taking payments. If you have paid for time after the last session, we will refund it.
 

Your membership is personal

Your membership is for you only. Please do not share session links, your login or the community with anyone else.

Session and community rules

Our sessions work because everyone feels safe to speak and make mistakes. When you join a session or post in the community, please:

• be respectful and patient with other members, whatever their level, accent or opinions;

• keep anything personal that other members share in a session within the group;

• do not record, photograph or screenshot a session or other members without their permission;

• do not use the sessions or the community to sell or advertise anything, or to send spam;

• do not post harassing, offensive, fraudulent or unlawful material.

We may remove posts, remove someone from a session, or suspend or end a membership if these rules are broken. If we end a membership because of a serious or repeated breach, we will tell you why and refund any unused part of the period you have paid for.

Limitations of Use

When you use this website, you agree that you will not:

• copy, modify, prepare derivative works of, decompile or reverse engineer any materials or software on this website;

• remove any copyright or other proprietary notices from any materials or software on this website;

• transfer the materials to another person or "mirror" the materials on any other server;

• knowingly or negligently use this website or our services in a way that abuses or disrupts our networks or any other service we provide;

• use this website or our services to transmit or publish any harassing, indecent, obscene, fraudulent or unlawful material;

• use this website or our services in breach of any applicable laws or regulations;

• use this website to send unauthorised advertising or spam;

• collect other users' data without their consent; or

• use this website or our services in a way that may infringe the privacy, intellectual property or other rights of others.
   

Intellectual Property

The materials on this website and in our sessions, including session notes, games, slides, videos and resources, are owned by or licensed to My English Habit and are protected by copyright and trademark law. You may download or keep one copy of the materials for your own personal, non-commercial use.

This is a licence, not a transfer of ownership. It ends automatically if you break these Terms of Service, and we may end it at any time.

Content You Share

You keep ownership of anything you post in the community or send to us. We will never claim ownership of your content.

If you post or share content in the community, you give us permission to display it there so that other members can see it. We will only use your words, name, image or video in our marketing (for example, as a testimonial) if you have given us permission to do so. You can ask us to stop using them at any time, and we will remove them from anything we control.

Liability

We provide our website and services with reasonable care and skill. Nothing in these terms limits your legal rights as a consumer, or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

We are not responsible for losses that were not reasonably foreseeable when you signed up, or for business losses such as lost profits, revenue, business or opportunities. The sessions help you practise and improve your speaking. We cannot guarantee a particular result, such as a test score or a job outcome.

The materials on our website are for general information only. We do not guarantee that they are complete, accurate or up to date.

Links

Our website and community may link to other websites and services, including Skool and Google Meet, which we do not control. Those services have their own terms and privacy policies. We are not responsible for their content, and a link does not mean we endorse them.

Right to Terminate

We may suspend or end your use of our website or services if you seriously or repeatedly break these Terms of Service. We will tell you in writing (by email) when we do this.

Severance

If any part of these Terms of Service is found to be void or unenforceable, that part is removed and the rest of the terms remain in force.

Complaints

If you are unhappy with our service, please email info@myenglishhabit.net. We will reply within 14 days and try to put things right.

Governing Law

These Terms of Service are governed by the laws of England and Wales. If you are a consumer, you also keep the protection of any mandatory consumer laws of the country where you live, and you can bring legal proceedings in the courts of that country.
